Post Installation Support
BG-BASE is protected by copyright law and by our defined licensing requirements. This means that you may install it only a single computer to be used (except when used on a network; see below), and you may make archive copies of the software for the sole purpose of backing up and protecting your investment from loss.

This software may be used by any number of people, and may be freely moved from one computer or location to another, so long as there is no possibility of it being used by more than one person at a time (except when used on a network; see below). The software may not be available for use by two different people in two different places at the same time (except when used on a network; see below) without a sub-license from BG-BASE, Inc. Using the software by two different people in two different places at the same time (except when used on a network; see below) is a violation of software license agreement.

BG-BASE is licensed to a single copy, whose use is controlled by the licensing restrictions set out by Revelation Software. Sub-licenses are available from BG-BASE, Inc. for those institutions wishing to run a read-only copy of BG-BASE as well as the main copy.

Networked use
The above statements concerning single-machine use of BG-BASE are modified as follows for those users who have purchased and installed the appropriate Revelation Software network products and are using BG-BASE on a Local Area Network (LAN) or across a Wide Area Network (WAN). In no case can more than one copy of the same AREV.EXE or OINSIGHT.EXE executable files be run simultaneously on different computers.

Source code
Except as may be negotiated under separate contract, all source code used in BG-BASE remains the property of BG-BASE, Inc.

Restrictions
You may not alter, merge, modify or adapt the software in any way including disassembling or decompiling. You may not loan, rent, or lease the software or any copy.

Transferring the software
You may transfer all of your rights to use the software to another institution, provided that you transfer to that institution all of the software, diskettes, and documentation provided with the product, and transfer or destroy all copies in any form. Once you transfer the software you no longer have any right to use it, and the institution to whom it is transferred may use it only in accordance with the copyright law, international treaty, and this statement. Any support agreements in effect at the time of such transfer are not transferrable. A new License Agreement must be signed by the institution to which BG-BASE is being transferred.

This software is subject to U.S. Commerce Department export restrictions, and is intended for use in the country into which BG-BASE, Inc has sold it (or in the EEC, in the case of software BG-BASE, Inc. first sold into the EEC). Except as provided in this statement, you may not transfer, rent, lease, lend, copy, modify, translate, sub-license, time-share, or electronically transmit or receive the software, media, or documentation.

Upgrading
If you have purchased an upgrade for an existing version of BG-BASE, it constitutes a single product with the previous version of BG-BASE. For example, the upgrade and the software that you upgraded cannot both be available for use by two different people at the same time, cannot be applied to more than one licensed product, and cannot be transferred separately, without written permission from BG-BASE, Inc.

Limited warranty
BG-BASE, Inc. warrants the physical media and physical documentation provided by BG-BASE, Inc. to be free of defects in material and workmanship for a period of ninety (90) days from the original purchase date. If BG-BASE, Inc. receives notification within the warranty period of defects in materials or workmanship, and determines that such notification is correct, BG-BASE, Inc. will replace the defective media or documentation.

The entire and exclusive liability and remedy for breach of this limited warranty shall be limited to replacement of defective media or documentation and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of profit, data, or use of the software or special, incidental or consequential damages, or other similar claims, even if BG-BASE, Inc has been specifically advised of the possibility of such damages. In no event will BG-BASE, Inc.'s liability for any damages to you or any other person ever exceed the price paid for the package (minus the daily rates charged for installation and training), regardless of the form of the claim.

BG-BASE, Inc. assumes no liability if the user operates, or attempts to operate, BG-BASE in ways not covered in the BG-BASE documentation.

BG-BASE, Inc. specifically disclaims all other warranties, representations or conditions, express or implied, including but not limited to any implied warranty or condition of merchantability or fitness for a particular purpose. All other implied terms are excluded.

Specifically, BG-BASE, Inc. makes no representation or warranty that the software or documentation are "error-free" or meet any user's particular standards, requirements, or needs. In all events, any implied warranty, representation, condition, or other term is limited to the physical media and documentation and is limited to the 90-day duration of the limited warranty.

BG-BASE, Inc. is not responsible for, and does not make any representation, warranty, or condition concerning product, media, software, or documentation not manufactured or supplied by BG-BASE, Inc., such as third parties' programs designed to work with BG-BASE or which include BG-BASE programs or files.

General provisions
This statement may be modified only in writing signed by you and an authorized officer of BG-BASE, Inc. If any provision of this statement is found void or unenforceable, the remainder will remain valid and enforceable, according to its terms. If any remedy provided is determined to have failed of its essential purpose, all limitations of liability and exclusions of damages set forth in the limited warranty shall remain in effect.

This statement shall be construed, interpreted and governed by the laws of the State of Ohio, U.S. This statement gives you specific legal rights; you may have others which vary from state to state and from country to country. BG-BASE, Inc. reserves all rights not specifically granted in this statement.
